Introduction
Below you will find the General Terms and Conditions. These terms and conditions apply whenever you place an order through our website and contain important information for you as a buyer. Therefore, please read the General Terms and Conditions carefully. We also recommend that you save or print these terms so that you can review them at a later time.
Article 1 – Definitions Gymsetz is a company based in the Netherlands and registered with the Chamber of Commerce under registration number 91337429. It operates under the name Gymsetz. The website of Gymsetz is available at Gymsetz.com, including all associated subdomains. Customer refers to a natural person who does not practice a profession or business and enters into an agreement with Gymsetz and/or has registered on the website. Agreement refers to any arrangement or agreement between Gymsetz and the customer that complies with the provisions of the general terms and conditions. General Terms and Conditions refer to the current set of terms applicable to the services and agreements of Gymsetz. Our email address is: support@gymsetz.com.
Article 2 – Applicability of the General Terms and Conditions The General Terms and Conditions apply to all offers, agreements, and deliveries from Gymsetz. If the customer includes provisions or conditions in their order, confirmation, or communication that deviate from or are not included in the General Terms and Conditions, these are only binding for Gymsetz if Gymsetz has expressly and in writing accepted them.
Article 3 – Prices and Information The prices listed on the Gymsetz website include VAT and other government levies. The displayed prices include shipping costs. Although the content of the website has been compiled with great care, Gymsetz cannot guarantee that all information on the website is always complete and accurate. Gymsetz reserves the right to correct prices and other information on the website and in other materials in the event of obvious programming and typographical errors. Gymsetz cannot be held responsible for any (color) deviations due to differences in screen quality.
Article 4 – Copyright It is not permitted to copy and use our visual material for commercial purposes by third parties. The visual material we use is unique and exclusively owned by Gymsetz. If someone uses our material for commercial purposes, we will issue an invoice addressed to the respective company. Prices for such use range from €300.00 to €900.00. With permission, it is possible to use visual material for blogs and other publications, provided it benefits Gymsetz.
Article 5 – Conclusion of Agreement The agreement between Gymsetz and the customer is established when the customer accepts the offer from Gymsetz and meets the conditions set by Gymsetz. If the customer has accepted the offer electronically, Gymsetz will immediately confirm receipt of the acceptance electronically. As long as this confirmation has not been received, the customer has the opportunity to dissolve the agreement. If it appears that the customer has provided incorrect information when accepting the agreement or otherwise, Gymsetz has the right to fulfill its obligations only after receiving the correct information.
Article 6 – Execution of Agreement After receiving the order, Gymsetz will ship the products as soon as possible, considering the provisions stated in paragraph 3 of this article. Gymsetz reserves the right to engage third parties in fulfilling its obligations arising from the agreement. The standard delivery time is 1 business day (only for successful transactions before 4:00 PM) and up to a maximum of 3 business days. The delivery method may vary, at the discretion of Gymsetz. Gymsetz advises the customer to inspect the delivered products within a reasonable period and preferably report any defects in writing or via email to support@gymsetz.com, as described in the article on warranty and conformity. Once the products to be delivered have been delivered to the specified delivery address, the risk regarding these products transfers to the customer.
Article 7 – Right of Withdrawal If the customer is a natural person who does not act in the exercise of their profession or business, they have the right to dissolve the distance agreement with Gymsetz free of charge within 14 business days after receiving the product, without stating reasons. The customer only bears the direct costs for returning the product. Any shipping and payment costs paid by the customer for the delivery of the product will be refunded upon the return of the full order. During the mentioned withdrawal period, the customer will handle the product and packaging with care. The customer will only open the packaging and use the product to the extent necessary to assess the nature, characteristics, and functioning of the product. The customer can dissolve the agreement as described in paragraph 1 of this article by returning the product within the specified period to Gymsetz or by notifying Gymsetz within this period of their intention to withdraw from the purchase and then returning the product as soon as possible. Any amounts prepaid by the customer will be refunded as soon as possible, but no later than 30 days after the dissolution of the agreement.
Article 8 – Payment The customer must make payments to Gymsetz according to the payment methods indicated during the ordering process on the website. Gymsetz offers various payment methods, such as iDEAL, credit card, and/or PayPal. However, Gymsetz reserves the right to determine which payment methods are offered and may change this choice from time to time.
Article 9 – Warranty and Conformity Gymsetz guarantees that the products comply with the agreement, the specifications stated in the offer, reasonable requirements of reliability and usability, and the applicable legal provisions and government regulations at the time of concluding the agreement. If specifically agreed upon, Gymsetz also guarantees that the product is suitable for purposes other than normal use. If the delivered product does not comply with the agreement, the customer must notify Gymsetz within a reasonable period after discovering the defect. If Gymsetz considers the complaint justified, it will repair, replace, or refund the relevant products in consultation with the customer. The maximum compensation is equal to the price paid by the customer for the product.
Article 10 – Complaints Procedure If the customer has a complaint about a product or other aspects of Gymsetz’s service, they can contact Gymsetz via email at support@gymsetz.com. Please clearly state your complaint and order number if it concerns a purchased product. Gymsetz will respond as soon as possible, but no later than 3 days after receiving the complaint. If a full and substantive response is not possible within this timeframe, Gymsetz will confirm receipt of the complaint within 3 days and indicate when a substantive or final response can be expected.
Article 11 – Privacy Policy Gymsetz processes personal data of the customer in accordance with the privacy policy available on the website.
Article 12 – Cookies Gymsetz uses cookies to improve your visit to our website. Cookies are small text files stored by your browser on your computer. They allow us to recognize you and collect information about your visit to our website so that we can improve and tailor our services to your needs. Our cookies do not contain personally identifiable information. You can choose to disable cookies in your browser settings, but this may affect the functionality of our website.

Article 14 – Shipping & Returns
Orders placed before 4:00 PM will be shipped the same day and, in most cases, delivered the next day if the items are in stock. Products are delivered within 2-3 business days. You have 15 minutes after placing your order to cancel it.
You have 14 days from the receipt of the product to return it without providing a reason. The full purchase amount, including shipping costs, will be refunded to you according to the payment method you used at the time of ordering. The amount will appear in your account within 14 days, depending on the chosen payment method, provided the product is received by us without damage. Return shipping costs are at your own expense; you can request a return label through our website or create one through a carrier of your choice. If you exercise your right of withdrawal, you must return the product with all supplied accessories and, if reasonably possible, in its original condition and packaging.
Article 15 – Exceptions to Returns Damaged products cannot be returned. If an item is returned with damage, the amount will not be refunded to the customer. Products made by the entrepreneur according to the consumer’s specifications cannot be returned. Personal products cannot be returned. Returns are not accepted after 14 days.
A return shipment must include a track & trace code. Once we have received the returned items, the purchase amount will be refunded to your account within 14 days.
Article 16 – Timeframe for Quality Evaluation
After receiving your package in our warehouse, the quality evaluation will be conducted within 48 to 72 hours. Please note that for some products, this process may take longer.
Article 17 – Timeframe to Receive Your Replacement
If you have requested a replacement item, you can expect to receive it within 2-4 weeks from the date we receive the tracking information for the returned item and the quality evaluation is completed.
Article 18 – Timeframe for Refund
Customers who have requested a refund can expect to receive it within 14 days after the returned item has been received.
Article 19 – Product Exchange
If you wish to exchange a product, please contact us via the contact form on our website. Please note that you are responsible for the return shipping costs.
Article 20 – I Provided the Wrong Shipping Address
If you accidentally provided the wrong shipping address, please contact us as soon as possible. We will do our best to amend the order for you.
Article 21 – Warranty
You can count on us to deliver our products with care and in good condition. However, it may happen that an order gets damaged during transport or that something else occurs that entitles you to a warranty. If you contact us within two weeks after discovering the defect, we will repair or replace the item free of charge, provided the defect is covered under warranty.
Article 22 – Privacy Policy
Gymsetz grants you access to the website www.Gymsetz.com (the Website) and invites you to purchase the offered products. Gymsetz reserves the right to adjust the content or remove parts of the Website at any time without notifying you.
Article 23 – Limited Liability
Gymsetz strives to regularly update and/or supplement the content of the Website. However, it may occur that the content is incomplete and/or incorrect. Gymsetz reserves the right to cancel transactions that have already been completed. Regarding prices and other information about products on the Website, we reserve the right for obvious programming and typing errors. You cannot claim an agreement with Gymsetz based on such errors.
Article 24 – Copyright
Gymsetz holds all intellectual property rights to these materials. You are not allowed to copy, distribute, or use these materials in any other way without written consent from Gymsetz, unless legally permitted (such as under the right to quote) or otherwise specified for specific materials. The use of images for commercial purposes is not allowed and may result in a minimum invoicing of €300.00. Permission must be requested for the use of images for blogs and other publications.
Article 25 – Other Provisions
Gymsetz is entitled to modify the Terms and Conditions. The modified conditions will come into effect at the time specified by Gymsetz.
Dutch law exclusively applies to all legal relationships in which Gymsetz is involved, even if the obligations are performed entirely or partially abroad, or if the party involved in the legal relationship resides there. The applicability of the Vienna Sales Convention is excluded.
Any disputes related to or arising from offers made by Gymsetz or agreements made with Gymsetz will be submitted to the competent Dutch court.
